Overvak Inc. ("Overvak," "we," "our," or "us") provides smart monitoring technology, mobile applications, artificial intelligence-powered event detection, video and audio processing, highlights, notifications, and related services designed to help parents and caregivers stay connected to important moments in a child's day.

We respect the privacy of our users and the families whose information may be processed through our Services. This Privacy Policy explains how we collect, use, process, disclose, retain, and protect personal information and describes the privacy choices and rights that may be available to you.

1. Scope

This Privacy Policy applies to personal information processed by Overvak through our mobile applications, websites, connected cameras and devices, artificial intelligence systems, customer support, and other online or offline offerings (collectively, the "Services").

Overvak Inc. is responsible for the personal information we process as described in this Privacy Policy, except where otherwise stated.

2. Personal Information We Collect

The information we collect depends on how you interact with Overvak and which Services and features you use.

A. Information You Provide

Account Information. We may collect your name, email address, authentication information, profile information, time zone, account preferences, and other information you provide when creating or managing an Overvak account.

If you create an account using Apple, Google, or another third-party authentication provider, we may receive information that you authorize that provider to share with us.

Child and Household Information. You may provide information relating to a child or household, such as a child's name or nickname, age or date of birth, profile image, household information, caregiver information, camera location or room name, and monitoring preferences.

Communications. We collect information you provide when you contact customer support, participate in surveys, provide feedback, report an incorrect detection, communicate with us, or otherwise submit information through the Services.

B. Camera, Video and Audio Information

When you connect a compatible camera or device to Overvak, the Services may collect, transmit, process, analyze, and store video, images, audio, and related information captured by that device.

This information may include:

  • Live camera video and audio;

  • Recorded video or audio;

  • Event clips;

  • Images or video frames;

  • Timestamps;

  • Camera and room information;

  • Detected activities and events;

  • AI-generated classifications, outputs, and confidence information;

  • User feedback concerning detections;

  • Highlights and summaries generated from detected events; and

  • Other information necessary to operate, maintain, develop, and improve the Services.

C. AI-Generated and Derived Information

Overvak uses artificial intelligence, machine learning, computer vision, audio analysis, and other automated technologies to analyze information processed through the Services.

These systems may generate information such as detected activities, event labels, timestamps, clips, summaries, highlights, notifications, confidence scores, and other inferences regarding activity occurring within the camera environment.

D. Device and Technical Information

We may automatically collect information such as your IP address, mobile device type, operating system, application version, device identifiers, camera identifiers, network information, Wi-Fi information necessary for device setup, crash logs, diagnostic information, and similar technical data.

E. Usage Information

We may collect information regarding your interactions with the Services, such as features used, screens viewed, notifications opened, clips viewed, detection feedback submitted, settings selected, frequency and duration of use, and other information regarding how you interact with Overvak.

F. Information From Other Sources

We may receive information from third parties, including authentication providers, app stores, analytics providers, camera and device providers, payment processors, and other service providers that support the Services.

3. How We Use Personal Information

We may use personal information for the following purposes.

A. Providing the Overvak Services

We may use information to:

  • Create and manage your account;

  • Authenticate users;

  • Connect and manage cameras and devices;

  • Provide live camera functionality;

  • Process and analyze video, images, and audio;

  • Use artificial intelligence to detect activities and meaningful moments;

  • Create event clips, highlights, and summaries;

  • Send notifications and alerts;

  • Provide preferences and personalized functionality;

  • Maintain and troubleshoot the Services; and

  • Provide customer and technical support.

B. Maintaining, Improving and Developing Overvak

We may use information to:

  • Monitor and improve Service performance;

  • Evaluate the accuracy and reliability of detections;

  • Identify false positives, false negatives, and other detection errors;

  • Debug and resolve technical problems;

  • Conduct research and development;

  • Develop new features, products, services, detection capabilities, algorithms, and artificial intelligence technologies;

  • Improve the accuracy, reliability, and performance of our artificial intelligence and machine-learning systems;

  • Train, fine-tune, test, validate, and evaluate Overvak's artificial intelligence and event-detection models where permitted by applicable law;

  • Conduct internal quality assurance and testing; and

  • Create de-identified or aggregated information.

C. AI Model Development and Improvement

Because artificial intelligence is a core component of the Overvak Services, we may use information processed through the Services—including, where permitted by applicable law, video, audio, images, event clips, detection results, AI-generated information, user feedback, and other eligible information—to research, develop, train, fine-tune, evaluate, test, validate, and improve Overvak's artificial intelligence models, algorithms, and detection systems.

Where appropriate, we may take steps to minimize, remove, separate, or otherwise reduce information that directly identifies an account holder before information is used for these purposes.

Where applicable law requires additional notice, consent, an opt-out right, or another choice before particular personal information may be used for artificial intelligence development or improvement, Overvak will provide the applicable notice or mechanism.

D. Safety, Security and Fraud Prevention

We may use information to maintain the integrity and security of the Services, prevent unauthorized access, detect and investigate fraud or misuse, enforce our Terms of Service, and protect Overvak, our users, and others.

E. Communications

We may communicate with you regarding your account, security, Service updates, policy changes, customer support, and other administrative matters.

Where permitted by law, we may also send marketing communications. You may opt out of marketing communications without affecting transactional or Service-related communications.

F. Legal Obligations

We may process information as reasonably necessary to comply with applicable laws, regulations, legal processes, and enforceable governmental requests and to establish, exercise, or defend legal claims.

4. Artificial Intelligence and Automated Processing

Artificial intelligence is a core component of the Overvak Services.

Overvak may use artificial intelligence and automated technologies to analyze video, audio, images, and related information and identify events such as crying, jumping, climbing, falls, and other activities supported by the Services.

Overvak may use these detections to generate notifications, event clips, highlights, summaries, and other features.

Artificial intelligence systems are not perfect. A detection may be incorrect, an event may not be detected, a notification may be delayed, or an AI-generated description or classification may be inaccurate.

Overvak should not be relied upon as the sole means of supervising a child, identifying an emergency, preventing injury, or making medical or safety decisions.

5. How We Disclose Personal Information

We may disclose personal information as necessary to operate, maintain, protect, and support the Services.

A. Service Providers

We may provide information to companies that perform services on our behalf, including providers of:

  • Cloud infrastructure and storage;

  • Camera connectivity and device services;

  • Video and audio processing;

  • Artificial intelligence and machine-learning infrastructure;

  • Authentication;

  • Analytics;

  • Application monitoring;

  • Customer support;

  • Security and fraud prevention;

  • Communications; and

  • Payment processing.

These providers may process information for authorized purposes subject to applicable contractual and legal requirements.

B. Business Transactions

If Overvak is involved in a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar corporate transaction, personal information may be disclosed or transferred as part of that transaction, subject to applicable law.

C. Legal and Safety Reasons

We may preserve, access, or disclose information if we reasonably believe doing so is necessary to comply with law or legal process; enforce our agreements; investigate fraud, security incidents, or unlawful activity; or protect the rights, property, or safety of Overvak, our users, children, or others.

D. At Your Direction or With Your Consent

We may disclose information when you direct us to do so or otherwise provide consent.

Overvak does not sell camera video or audio to third parties. Overvak does not permit third parties to use private camera video or audio for their own advertising purposes.

Overvak does not sell personal information for monetary consideration.

6. Information About Children

Overvak is designed for use by parents, legal guardians, caregivers, and other authorized adults. Children are not intended to create or independently operate Overvak accounts.

Our Services may process information relating to children when that information is provided, authorized, or captured through an account controlled by an adult.

By providing information concerning a child or connecting a camera that captures a child, you represent that you have the legal authority to do so and any permissions or consents required by applicable law.

If we learn that a child has created an Overvak account or directly provided personal information to us in violation of applicable law, we will take appropriate steps to delete the information and terminate the account where required.

Parents or legal guardians may contact us regarding eligible requests to access, correct, or delete information relating to their child.

Nanit currently follows a similar adult-account model: its Terms restrict use to adults while recognizing that providing the service involves information concerning children.

7. Cameras, Recording and Other Individuals

Cameras and connected devices used with Overvak may capture video or audio of individuals other than the account holder or child, including caregivers, babysitters, nannies, household employees, family members, household members, and visitors.

The account holder is responsible for the placement and use of connected cameras and for complying with applicable privacy, surveillance, video-recording, audio-recording, employment, and consent laws.

Depending on where you live and the circumstances in which a camera is used, applicable law may require you to provide notice or obtain consent before recording or monitoring another person.

Overvak does not determine whether your particular camera placement or recording practices comply with applicable law.

8. Your Privacy Choices and Rights

Depending on where you live and subject to applicable law, you may have the right to:

  • Request access to personal information;

  • Request correction of inaccurate personal information;

  • Request deletion of eligible personal information;

  • Obtain a portable copy of certain personal information;

  • Withdraw consent where processing is based on consent;

  • Object to or restrict certain processing;

  • Opt out of certain sales, sharing, targeted advertising, or profiling where applicable;

  • Appeal certain privacy-rights decisions; and

  • Exercise other rights provided by applicable law.

You may submit a privacy request by contacting legal@overvak.com or through privacy controls made available through the Services.

We may need to verify your identity before processing certain requests.

We will not unlawfully discriminate against you for exercising your privacy rights.

9. De-Identified and Aggregated Information

We may create de-identified or aggregated information from personal information.

We may use de-identified and aggregated information for research, analytics, product development, artificial intelligence development and improvement, business planning, and other lawful purposes.

Where required by applicable law, we will maintain such information in de-identified form and will not attempt to re-identify it except as permitted by law.

10. Data Retention

We retain personal information for as long as reasonably necessary to provide the Services, fulfill the purposes described in this Privacy Policy, maintain security, comply with legal obligations, resolve disputes, enforce agreements, and pursue legitimate business purposes.

Different categories of information may have different retention periods.

Camera recordings, event clips, and highlights may be retained according to the storage functionality associated with your account and Service.

When information is no longer reasonably necessary, we may delete, anonymize, or de-identify it in accordance with applicable law.

11. Security

We use administrative, technical, and organizational safeguards designed to protect personal information from unauthorized access, loss, misuse, alteration, or disclosure.

These safeguards may include encryption, access controls, authentication mechanisms, security monitoring, and other measures appropriate to the nature of the information.

However, no method of electronic transmission or storage can be guaranteed to be 100% secure.

12. U.S. State Privacy Rights

Residents of California and certain other U.S. states may have additional rights under applicable comprehensive state privacy laws.

Where applicable, these may include rights to access, correct, delete, or obtain personal information and rights to opt out of certain sales, sharing, targeted advertising, profiling, or other processing.

Overvak will provide additional state-specific notices and mechanisms where required by applicable law.

13. International Data Transfers

Overvak and its service providers may process and store information in the United States and other countries.

Where required by applicable law, we will implement appropriate safeguards for international transfers of personal information.

14. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes to our Services, data practices, technology, or legal obligations.

If we make material changes, we will provide notice as required by applicable law.

The "Last Updated" date at the top indicates when this Privacy Policy was most recently revised.
